Grain Valley, MO – The Owner-Operator Independent Drivers Association has filed a second complaint against the Federal Motor Carrier Safety Administration regarding how the agency stores drivers’ safety records.
The lawsuit, filed May 23 with the U.S. District Court of Appeals for the District of Columbia Circuit, alleges that FMCSA releases records of safety violations to possible employers before drivers have gone to court and does not remove references to violations that have been dismissed.
OOIDA filed the complaint on behalf of a member who received a ticket in Montana for failing to stop at a weigh station. The ticket was eventually dismissed, but reportedly has not yet been removed from FMCSA’s national safety record database. OOIDA is seeking to prevent FMCSA from reporting that the truck driver violated the law and is asking that the information be purged from his records.
The first complaint was filed July 13 and is pending, according to an OOIDA press release.
