Let workers use the restroom, Washington state tells port and rail yard operators

Tumwater, WA — Drayage truck drivers, stevedores and longshore workers in or on a Washington state-based port or rail yard property must be given access to restroom facilities, under a new law.

Operators also must provide a dedicated space for lactation.

The rule aligns Chapter 296-56 of the Washington Administrative Code with requirements mandated in Substitute H.B. 1706, which went into effect in June 2022.

The new rule also:

  • Aligns Chapter 296-56 with OSHA requirements for marine terminals (29 CFR 1917) by removing outdated references and practices, and adding clarity on the meaning of heavily loaded container and measuring carbon monoxide.
  • Clarifies OSHA’s requirement to ensure employers provide information in a language that employees understand.
  • Incorporates housekeeping and formatting updates to improve readability and accessibility.

The new rule goes into effect on April 20.
