Topeka, KS — Drivers in Kansas now face new penalties for using a handheld mobile device in active construction work zones, under a new state law.
Signed by Gov. Laura Kelly (D) in April, S.B. 366 is aimed at strengthening construction worker safety and curbing distracted driving. The law, which went into effect July 1, also applies in school zones. The bipartisan legislation overwhelmingly passed in the state Senate (31-9) and House (116-7).
For the first year, any driver caught violating the law will receive a warning citation. Beginning on July 1, 2027, violators will be given a $60 traffic citation.
The law defines “active construction zones” as those where workers are present and signs are posted alerting drivers to their presence. The law applies in school zones where a reduced speed limit is enforced.
As an additional safety measure, the law permits green lights to be displayed on construction and maintenance vehicles and blue lights on stationary trailers in work zones from sunset to sunrise, in addition to the amber and white colors that are currently allowed.
