OSHA to issue new whistleblower protections

Two new interim final rules on whistleblower protection from OSHA currently are being reviewed by the Office of Management and Budget.

One rule would implement procedures to handle and investigate retaliation complaints from various transportation industry employees, as well as employees of contractors or subcontractors, who report safety and security violations. The rule was made possible by the Implementing Recommendations of the 9/11 Commission Act of 2007, which amended the Federal Rail Safety Act and 29 CFR 1978 of the Surface Transportation Assistance Act.

The second rule would establish procedures for handling and investigating retaliation complaints from employees in the consumer product industry who report violations of the Consumer Product Safety Act. OSHA was granted the power to administer such a rule by the Consumer Product Safety Improvement Act of 2008.

OMB received both rules for review on May 19; the rules are scheduled to be issued in August.
