Arlington, VA – The American Trucking Associations filed a petition on Feb. 14 with the U.S. Circuit Court of Appeals for the District of Columbia over the Federal Motor Carrier Safety Administration’s hours-of-service final rule (.pdf file) issued last December. The rule limits drivers’ ability to restart their weekly maximum driving time.
ATA has previously claimed that the former HOS regulations, which allowed unrestricted use of a 34-hour restart of weekly driving hours, have been successful in reducing roadway fatalities and cited National Highway Traffic Safety Administration data (.pdf file) that indicates large-truck-related deaths have declined since the previous current rules were put in place.
ATA also takes issue with FMCSA’s own finding that implementing the new final rule will incur more costs than it saves.
