OSHRC resolves last ‘legacy’ case on docket
Washington – The Occupational Safety and Health Review Commission on Sept. 28 issued a ruling on its final “legacy” case, clearing the docket of the commission’s oldest cases.
The 10 legacy cases – so called because of their age and complexity – dealt with difficult issues such as multi-employer worksites, successor liability and continuing violation theory. With the commission’s ruling on the Southern Scrap Materials Co. case, which was on the docket since 1994 and the second-oldest legacy case, the commission resolved all legacy cases before fiscal year 2012 began Oct. 1 and completed part of its 2010-2015 strategic plan (.pdf file) goals.
The commission vacated most of the citations issued to Southern Scrap Materials related to OSHA’s Lead Standard (1910.1025), but upheld several Cadmium Standard (1910.1027) violations.
