MIOSHA creates new settlement program

Lansing, MI – Michigan OSHA is set to launch a new informal settlement process in November.

Formerly known as the Informal Settlement Agreement, the Penalty Reduction Agreement will allow employers to receive a 50 percent reduction in MIOSHA penalties if they agree not to appeal the citations, and if they promptly correct the hazards and pay the reduced fine within 15 working days.

Employers must apply for a PRA within five days of receiving a citation. Investigations related to a workplace fatality, or resulting in a willful citation or qualification for the Severe Violator Enforcement Program, are not eligible for a PRA.

Employers are not required to pursue a PRA; they may dispute the citations.
